就陳淑莊議員對《2012年撥款條例草案》

全體委員會審議階段動議修正總目22致辭全文：

陳淑莊議員就《2012年撥款條例草案》動議修正案，建議將總目22漁農自然護理署（漁護署）的開支預算削減65萬元，把該署對動物管理中心所接收的動物進行人道毀滅的撥款減半。政府反對這項修正案。

政府與各位議員和市民大眾一樣，我們並不願意看到太多流浪動物被人道毀滅。歸根究底，這個問題的根源，是一些寵物主人未經深思熟慮便收養動物，而最後卻因為種種原因而未能妥善照顧牠們，令牠們流離失所，成為流浪動物，受到飢餓和疾病之苦。

過去三年，漁護署每年收到約20 000宗有關流浪動物的投訴，反映很多市民正受到流浪動物的滋擾。更重要的是，流浪動物比一般動物更有可能患有人畜共通病，威脅市民大眾的健康，例如狂犬病、寄生蟲症，或其他細菌感染。就以狂犬病為例，即俗稱「瘋狗症」，是由狂犬病病毒引起的人獸共通中樞神經系統傳染病，世界各地每年約有55 000人死於此病。香港鄰近地方包括內地及不少東南亞國家都是狂犬病疫區，而我們現時仍是世界上少數擁有「非疫區地位」的地區，二十多年來沒有一宗新病例。由於狂犬病是至今為止人類唯一病死率差不多高達百分之一百的急性傳染病，所以我們絕不能鬆懈。為了保障市民的健康，政府有責任減少流浪動物。

根據外國經驗，流浪動物之間容易互相傳播動物傳染病或人畜共通病。流浪動物數目越大，對人類及其寵物所產生的交叉感染機會亦相對增加。如修正案獲得議員通過，將限制漁護署對部分流浪、被遺棄或帶病的動物進行人道毀滅。在香港這高度人口密集的城市，不加以控制流浪動物的數目，不但會增加市民和動物健康的風險，更嚴重威脅公共衛生。

有建議認為可以把動物長期關起來飼養，但這是否對動物最佳的安排？目前漁護署只有四個動物管理中心，不能無休止地接收並長期飼養動物，就算不斷增建收容中心，也不能滿足需求，收容中心很快又會住滿動物，無法長遠解決問題。更重要的是，在接收的動物當中，不少都有受傷、患有不同的疾病或年老，如果修正案獲得通過的話，政府未必能夠繼續依照國際一貫保障動物的做法，以人道毀滅方式終止牠們的受苦及痛楚。再者，若有關撥款被削減，為了要減少人道毀滅的個案，漁護署或須拒絕接收市民放棄飼養的動物及減少捕捉流浪動物，這亦不符合市民的期望。現時漁護署每年從寵物主人接收約2,500多隻動物，當中多是年老或傷病的貓狗，主人不希望這些動物受苦而希望漁護署能代為適當處理，讓牠們有尊嚴地離開這世界。削減這方面的資源會增加這些動物可能承受的痛苦。

此外，動物（特別是狗隻）須要有適當運動及社交活動，就算是健康的動物，捨人道毀滅而將牠們長期關起來，對牠們的生理和心理的狀況都會有負面的影響。由此可見，修正案非但不能解決問題，反而在市民健康、公共生、動物疾病、動物福利各方面，帶來反效果。

國際上的做法又是如何呢？香港處理流浪及遺棄動物的方法與國際社會的主流做法是一致的。將無人認領或收養的動物進行人道毀滅的方法，在世界各地的大城市被廣泛採用。世界動物保護協會和英國皇家防止虐待動物協會國際部，於二○○七年發表了有關約30個歐洲國家控制流浪貓狗方法的報告。報告指出，絕大部分的歐洲國家均有對流浪動物進行人道毀滅。而基於人道理由，人道毀滅患有疾病和受傷的動物，更是國際上權威的動物福利組織所支持的做法。香港人道毀滅動物的數字，以人均計算，遠比世界上很多先進地方為低。以每千人計算，美國平均人道毀滅12.5隻動物，澳洲為10隻，香港則為2.3隻，我們沒有印度的數字。

至於在過去數年，我們在二○○八年人道毀滅動物的數字有14,000多宗，至去年為止，已減至8,900宗。縱使如此，漁護署仍一直設法減少人道毀滅動物，其中最重要的一環是積極鼓勵市民領養動物。漁護署已加強與13個動物福利團體合作，安排動物領養服務，包括向所有經這些團體成功領養的動物，提供免費的外判絕育服務。透過漁護署及動物福利團體的努力，獲領養動物的數目已由二○○七年的709隻，增加至二○一一年的1,144隻。漁護署會繼續這方面的工作。

除此之外，我們已接納了多位立法會議員和動物福利團體的意見，正部署落實流浪狗隻「捕捉、絕育、放回」試驗計劃。這個計劃若要成功，社區的支持至關重要。在得到社區認同的地區，我們將容許經絕育的流浪狗隻在沒有狗主管制下放回公眾地方。我們已物色了三個選定地址，包括元朗流浮山，西貢蠔涌以及南丫島，並正聯同動物福利組織諮詢當區居民，稍後會諮詢立法會事務委員會和相關區議會的意見。

《防止殘酷對待動物條例》的最高罰則已於二○○六年提高至罰款$200,000及監禁3年，其後政府亦不斷採取措施，加強保障動物福利。繼二○一○年年初收緊動物售賣商牌照的附加條件後，我們現時正計劃加強規管寵物的買賣，進一步保障公眾健康和動物福利，我們將於下月把有關建議提交立法會事務委員會討論。

為了進一步加強與動物福利團體的合作，漁護署已於去年增加撥款100萬元，資助這些團體從事有關動物福利和管理的工作。

與此同時，為加強各相關部門和機構處理殘酷對待動物個案的合作，漁護署聯同警務處、食物環境生署及香港愛護動物協會成立跨部門特別工作小組，檢視殘酷對待動物個案的處理工作。工作的重點包括如何加強部門間互相支援、擬訂提高效率的指引、及設立機制讓相關專業部門和動物福利機構就案件提供專家意見，以全方位偵查有關的案件。

主席，我剛才已說明政府在動物管理方面全方位的工作。正如我在發言時說，我們跟各位議員一樣，都不願意看到動物遭遺棄、受苦，而最終被人道毀滅。要針對解決問題的根源，我們正致力減少流浪動物的產生。但面對已遭遺棄並不能獲領養的流浪動物，我們仍得處理。所以我想強調，人道毀滅是專業獸醫認同的一種動物管理方法，亦是一個人道的方法。我們現時的做法與先進國家一致。若陳淑莊議員的修正案獲通過，流浪動物的問題會加劇，影響公眾健康，增加公眾滋擾。主席，我謹此陳辭，懇請各位委員支持政府，反對這項修正案。
